Unemployed At 60 (But Not In The Least Discouraged)

Headlines for the Arizona Daily Star, July 10, 20098:30 a.m.  Arizona Daily Star's above-the-fold headline in big, bold typeface reads:  Fraud suit filed against Tucson real estate group.

The complaint by the AZ Attorney General's office includes the company where I'm a loan officer, Tucson Mortgage Company, LLC. 

8:40 a.m.  This is not good.  I call my Darlin' to break the news.

The press release by the AG's office includes the following language:

Defendants RE/MAX and Tucson Mortgage, and their respective owners and/or supervisors allegedly profited from the scheme and either knew or should have known of the fraud being perpetrated against lenders in these real estate transactions.

Sunshine through the storm9:48 a.m.  The first email out of corporate announces that effective immediately, loans from Tucson Mortgage will no longer be accepted by one major bank.  All loans in the pipeline will be honored.

10:31 a.m.  Email:  a second major bank will no longer accept loans from Tucson Mortgage.  Loans in the pipeline will be honored, but will go to corporate for review.

10:47 a.m.  Fax machine spits out a loan approval from an underwriter at the first bank to shut us down an hour earlier:  Clear to Close on one of my pipeline loans.  Thank you, God!

11:00 a.m.  A principle from another mortgage company calls to see if I'm interested in coming on board.  I don't know, but thanks.

1:20 p.m.  I have a $349,000 VA purchase application (referred by a REALTOR) that's been in the works since January.  The buyers finally have a signed contract on a bank-owned property.  The bank wants to close yesterday?!

I email the borrowers and the REALTOR (who's on vacation in the Carribean) that it would be in their best interest to place the loan with another mortgage company, citing today's headline.  I'll help expedite in any way they deem helpful.

3:15 p.m.  Message on my Blackberry from another mortgage company.  A phone call turns into an interview with a principle of the company.  I still don't know, but it's nice to be wanted.

4:10 p.m.  Driving to a 4:30 closing, I call my pastor and tell him what's going down.  He prays with me on the phone and suggests that I think of a way to start a networking group of the unemployed people like me in our congregation.  That brings a smile.  I can do that.

4:30 p.m.  Closing at title on a rate & term refinance (the one I blogged about last month where the appraisal got knocked way down and we extended the lock out to 60 days.)  Sitting in the lobby of the title company, I tell my client about the news, and ask her to put me on the prayer list.  (I believe in prayer, as does this client.) 

My client works for one of Tucson's major employers, and she suggests that I go on their HR website and look through the positions that are open in the company.  "Use my name as a reference," she said.  Wow!  I hadn't thought about changing careers for the fifth time in my life...

5:30 p.m.  Dinner with my Darlin' and two of her girlfriends at the Elle Wine Country Restaurant.    Smiles, joy and thankfulness.

11:00 p.m.  Writing this post, I'm reminded of the verse in Jeremiah 29:11  "I know the plans I have for you," says the Lord, "...plans to give you hope and a future."  I'll sleep well tonight.

Mike:  Wow... what a day.  I think it was truly a blessing of sorts that your day was so crammed with stuff to do that you did not have large blocks of time to sit and worry about what was going to happen next.  Now that it's a bit later in the day... hopefully your heart rate has come back down to somewhere approaching normal.  Somehow you will be fine, I am sure.  It sounds like your loan officer services are in demand... and that fact must at least be a boost to your self confidence.

You are in my thoughts, young man.  Count your blessings.  It sounds like having a very understanding wife is one of those blessings.  Be thankful.  Take care...

Another casualty of the mortgage mess.  Although, these "rent-to-own" schemes predate the mortgage mess of the past 3 years which reached about $3.5TRILLION in damage to the American economy.

I was approached by a company to find homes for them to "buy" under "contract for deed" contracts in Maryland a while ago.  They planned to hold the homes in their portfolio, "resell" them under "rent-to-own" contracts.  Not a problem???  Mmmm.  A trip to the county office of land records showed that a number of the homes this company had acquired by "land contracts" had foreclosure actions filed.  Clearly a fraudulent scheme to collect rents and not make mortgage payments. 

I can smell fraud when it enters the room.  These guys reeked of fraud. 

I reported them to the AG office in MD and they were put out of business.  I don't know what happened to the families to whom they sold the "rent-to-own" homes.  The folks had moved in and paid rent to the perps.  Sadly, they were not making mortgage payments and the many of the homes were on the way to foreclosure.

What is rarely written about when the AG offices report the schemes and the prosecution is the harm done to innocent employees of the companies with crooks at the helm.

Hang in.  You'll land on your feet.  Go take another photo of the Tucson sunset.

Who would have predicted this kind of thing three years ago?

You'll do ok - you're qualified, and compassionate, and well respected by your peers.

But your story is not unique, multiplied again and again across the country over the last couple of years, and many will not be as resillient as you.

Mike I wish I could put into words how horribly I feel for you.  Coming out of the blue like this has to add to the shock and sense of unbalance that this must make you feel.

You're one of the good guys.  Obviously that shines through because you have received calls for employment within minutes of the news breaking.

60 or 70 or 80..doesn't matter with the industry that you are in.  People need honest competent professionals.

Hi Mike - I heard about your post from Maureen McCabe.  Sorry to hear about this happening to you,  The people who've done that kind of stuff deserve to be caught and brought down.  Unfortunately, there are plenty of innocent people who end up in situations just like yours.  From what I've read, I've no doubt you'll land on your feet, and as others said, when one door closes another one opens.  May that new door be all you want it to be and then some.

Mr. Jones/Mike - This very post reminds me of why I should have stopped by more often.  You, my peer, seem exactly the type of guy that belongs in this business.  I so admire your honesty and transparency that I won't pretend to hide it behind a veil of not articulating it correctly.  Unemployed at 60, eh?  Shit man, seems to me that you aren't only a good guy in the Mortgage Biz, but more importantly, a good guy in life.

I am shocked, but not shocked.  In this meltdown climate ... well, anything can happen and usually does.

This whole thing is unsettling, at best, but you are a man of integrity who is well respected - both as a loan officer and a person.  You will land on your feet in a better situation.  I just know it.  God is coaching your team and it's your turn at bat.

Change and challenge keeps us humble.  Reminds us of where we came from - albeit not so gently sometimes.  I've changed careers enough times to know it's God's way of telling us we are capable of so much more.

Call me if there is anything I can do.  Even if you just want to vent.  We all need that at times, too.

I'll be saying prayers and sending them on the direct line.  He is watching, waiting ... and soon reveal the magnificent plan that is yours.  Let Ginny know that you both are embraced by an incredibly supportive 'family' here in the Rain.

Mike, I am so sorry you were caught up in this mess by association. Obvioulsy you would never do anything like that. After the shock has worn off, you will know what your next step is. It will be better, you already have people seeking you out so the open door will be better.

Ouch wake up call for Brokers to look at those transactions carefully. Sounds like they should have seen a pattern. Unfortunately I know many brokers don't do much supervising.

I hope you can pray with your eyes open, especially when you are driving. I know innocent until proven guilty, but why do people risk their freedom on a quick buck? I have worked with investors for over 16 years, and i have spoken at meetings of investors around the country. I hear the craziest schemes that could rival this one. Please if we are going to have regulations let's enact the if it seems to good to be true, it isn't true regulation. Reading your post, and seeing your knowledge, and juding from the immediate calls you have received, your reputation is intact and desired.

Wow, Mike.  I read those headlines up here in the Republic, but I didn't put two and two together.  Tucson Mortgage didn't register (you have branded yourself quite effectively as simply Mike in Tucson).  What a tremendous opportunity to figure out exactly what you want to do at this point of your life and where you want to do it.  One door closes and an infinite number of others open.  Best of luck sorting through all of the recruitment letters to find the one you really want.

I just saw this now and my first reaction is to feel the kick in the stomach it must have felt like when you first heard the news.  I'm reminded of a statement made to me many years ago.  "If you don't make a change yourself, life will do it for you."  I truly believe if you're meant to be somewhere else, walking another path, your step will be gently guided in that direction.  Best of luck choosing from all the possibilities laid out before you.

Firstly,  I'm not worried too much about you, Mike.  I'll bet you have 8-10 more calls, like the ones you already received, about a "job". 

Secondly, I wonder how legitimate the fraud allegation is.  Even so, the problem with financial services is that Tucson Mortgage, LLC is now guilty, in the eyes of the lender affiliates, regardless of the eventual outcome.

Enjoy the 3-day weekend; I'll bet you're back in business on Tuesday.  You just can't keep a good man down.

PS:  If you're an Arizona REALTOR, take note of what Mike just did; he's not hiding from anyone.  Oftentimes, loan originators have no control over the actions of other originators in their company.  Moreover, Mike's reputation for "client above self" is demonstrable.  This guy's gonna be with another mortgage outfit, by 5PM on Monday (if he chooses to).

Basically, you can be confident that it will be "business as ususal" as soon as Mike solves this tiny problem

Mike - Your post is the perfect example of triumphing over tragedy, and I believe you will do so. Your decision to pray at that moment and put in action a prayer team demonstrates your faithfulness and it hasn't gone unnoticed by God. Great things are in store for you! While we don't understand why things happen at the time, you have to believe God has His hand in it.

I had to stop at Cheryl's comment about opening your own shop.  Now that sounds like a plan.  I have no idea what's required to open a new mortgage company, but it doesn't sound like a bad idea.  You would be able to call the shots and keep the bad guys out!

I know you had nothing to do with the silly FRAUD that was the BIG Story this week in Tucson.  We are RE/MAX Majestic had nothing to do with it either. Unfortunately the guy Andrew Silverstein at RE/MAX All Executives did. 

Keep your chin up and go talk to Hunter Sampsel at American Home Mortgage. he is one of the most honest guys I've met in 14 years lbeing in the lending business.

You're right. We sometimes meet with an unplanned diversion in life's path. We really didn't plan to go that way, but somehow it happened. I have found that when that happens, everything works out in the end, just not the way I would have chosen...but it's all just fine!

Mike: Last Oct. at our regular sales meeting our boss strolled up to the white board and without saying a word, wrote these 2 words:

"I'm done"

There was a stunned silence, and then he announced the office would close in 2 weeks.

I sympathize with your position, and know what you are going through (without the part of the bad press)

Yes, I did consider leaving the mortgage business (for reasons those of us within the business can understand easily)

In the end, I landed somewhere better, but it was not easy, cost me business for sure, and was an emotional upheaval as well.

When I first read this here post by you, I sure could not believe my friend, Mike in Tucson was going through this. I was hoppen it was some kind of bad blogging dream I was a haven.

I sure do know one thing for sure, what ever it is that the AZ Attorney General's office. Think's was be-en done, I know deep inside, my friend was not at all any part of it.

I have absolutely no worries for you either. It might be a shock, but I am certain you are wise and have put yourself in a position to weather the storm. A concept frequently discussed in LDS circles is whether we are in the position of acting or being acted upon (based upon our own attitudes, decisions, and actions). I know you to be an actor, you are responsible and accountable to and for yourself. I can't wait to see what you turn this setback into.

I also know you are protected by what what you have sent out. You've helped MANY (and I've only known you for a few months 1.5 hours a week!) get what they want. Well, it's time for some karmic rebound.

Mike - Do not despair ! God has bigger and better plans for you! It takes a lot of faith and believing that God can and will turn the bad into good for the good of all. I had to believe that recently when I kept hitting a brick wall. For once in my life I stopped. I dared to just sit and wait for God. I am so glad that I did because the things that are now unfolding in my life are amazing. I will keep you in my prayers and I know God will bless you greatly.
